Man says gardaí gave him drug to befriend Bailey

A witness has told the High Court that he showed Ian Bailey cannabis that had been given to him by gardaí and told him he was being stitched up.

Martin Graham has told the court gardaí gave him cash, cannabis and clothes and asked him to befriend Ian Bailey in an attempt to get information linking him to the murder of Sophie Toscan Du Plantier.

This morning Mr Graham outlined an occasion on which he said gardaí gave him cannabis in order to befriend Mr Bailey.

However, he said his alarm bells started to ring like crazy and he realised this had got out of hand and realised something was wrong.

He said he knocked on Mr Bailey's door, showed him the cannabis and told him "you're being stitched".

He said he told Mr Bailey the police had given him cannabis to get closer to him.  

He said Mr Bailey asked him in and they sat and talked.  

He said Mr Bailey thought initially that this was fantastical and could not be true.      

The witness said Mr Bailey asked him if he would make a statement on the record of what the police had been doing.

He said he did so and Mr Bailey had made a recording of a conversation between them.

Earlier, the court heard about a statement Mr Graham had made to gardaí about Mr Bailey's demeanour after his arrest in February 1997 for the murder of Ms Toscan du Plantier.  

Mr Bailey came to the house in which Mr Graham was staying after his release from custody.   

Mr Graham said he had arranged to meet Detectives Jim Fitzgerald and Liam Leahy and they drove him around and brought him to Skibbereen for a meal.  

He said gardaí told him his statement was based on what he had told them and he trusted them.  

But he said some parts of it did not appear to be exactly what he had said.   

Mr Graham said Mr Bailey was totally agitated after his arrest.

He said Mr Bailey said he had been photographed outside Bandon Garda Station and said this would prejudice his case.

Mr Graham said references in the statement to Mr Bailey having gone walkabout, being possessed by the moon, blacking out, going up to the house and killing her, were the police description of what had happened.

Mr Graham said Mr Bailey seemed resolute that he was being fitted up.  

He said it seemed to him Mr Bailey did not know what was going on and was finding it all very confusing.    

He said gardaí were telling everyone what the scenario was.

But they did not know who to point the finger at and it seemed that they were just picking on someone.

He said the statement referred to Mr Bailey looking for someone called Irma.

He said Irma was very good at relaxing people with hypnosis and holistic therapies.

Mr Graham denied in court that Mr Bailey told him the day after his arrest, that if gardaí said he was  at the scene of the murder, then he must have gone up there and done the murder.

The court has heard details of a second statement given by Mr Graham to gardaí in April 1997.

In the statement, Mr Graham said Mr Bailey seemed sober and appeared agitated about what he had said.    

He said in the statement the remarks had stuck in his mind.  

But Mr Graham said in court he had never had this conversation and had never had a serious conversation with Mr Bailey.

Mr Graham also said other parts of the statement had been suggested to him by Detective Garda Jim Fitzgerald.
