Marie Farrell denies comment on damages

Retired Garda John Wilson has told the High Court that Ian Bailey and Jules Thomas remained under garda surveillance up until recent years at a level usually reserved for active criminal offenders.

Mr Wilson said he became concerned in 2011 during a Supreme Court case involving Mr Bailey about allegations of garda misconduct.

He decided to check the Garda Pulse system and found that Mr Bailey and Ms Thomas had remained under surveillance until 2012.

He said there were more than 150 entries on the system and the level of surveillance was usually reserved for active criminal offenders.

One of the entries dated October 2009 said:"Observed Ian Bailey and Jules Thomas having coffee at English Market. This is a regular haunt of these people, more so Ian Bailey as he is studying law at UCC".

The entries date back to 1999 when the Pulse system was introduced.

Mr Wilson began giving evidence after Marie Farrell completed her evidence after nine days in the witness box.

Ms Farrell denied telling a former employee that Ian Bailey was in line to get millions from his High Court action and that she would be getting her cut too.

Ms Farrell was under cross-examination for a sixth day in the action for damages by Ian Bailey against the gardaí and the State over his treatment as a suspect in the murder of Sophie Toscan du Plantier in west Cork in December 1996.

It was put to Ms Farrell that she had made contact late last year or early this year with a former employee, Geraldine O'Brien, and had discussed the Bailey case.

The court was told Ms O'Brien will give evidence to say that Ms Farrell told her Mr Bailey was in line to get millions from the court case and that she would be getting her cut too.

Ms Farrell said "that never happened".

She said she was friends with Ms O'Brien on Facebook and had only made contact with her to inquire about a beauty therapy course for her daughter.

It was put to her by the defence counsel that it would have been an unusual contact as the beauty course was in Cork and Ms Farrell's daughter was living in Roscommon.

Ms O'Brien was a teenager working for Ms Farrell in her shop in 1997 when Mr Bailey called to the shop.

Defence counsel Paul O'Higgins said Ms O'Brien would have been an important witness to the events of 1997 on a date when Mr Bailey was alleged to have told Ms Farrell he had embarrassing or dangerous information about her.

Farrell says insurance convictions irrelevant

Earlier, Ms Farrell told the High Court that questions about her and her son's convictions for driving without insurance had nothing to do with the Bailey case and was just "more personal stuff " to be thrown at her by gardaí.

Ms Farrell has previously told the court her children were targeted and harassed by gardaí, eventually forcing them to leave Schull.

It was put to Ms Farrell in cross-examination that her then 17-year-old son had been stopped a number of times driving without insurance in 2004 and this was the reason he was receiving attention from gardaí.

Ms Farrell had given evidence to a court on his behalf accepting responsibility for allowing the insurance payments to lapse.

In court today, Ms Farrell said a Garda Anthony Finn had stopped her 17-year-old son several times in one day but was also "persecuting" her 13-year-old son.

Counsel for the State Mr O'Higgins said this would be denied by the garda.

Ms Farrell was pressed about her evidence to the court in her son's case and said she could not remember some of the detail of it.

However, she said she knew defence counsel would have the information as "of course the gardaí would have given it to you.

"It's public record. It's nothing to do with Ian Bailey, it is just more personal stuff to throw at me."

The court was told Ms Farrell also had four convictions for driving without insurance.

She said she had learned her lesson about insurance.

Ms Farrell's cross-examination has finished and she is being re-examined by lawyers for Mr Bailey.
