Govt publishes terms for Cavan garda inquiry

The Government has published the terms of reference for the Commission of Investigation into allegations of garda malpractice in Bailieboro in Co Cavan between 2007 and 2010.

The commission will examine all the allegations made by Sergeant Maurice McCabe that were highlighted in the Guerin Report.

It was claimed that serious crimes, including assaults, sexual assaults, false imprisonment and child pornography, were not properly investigated.

The commission is to be led by former High Court judge Mr Justice Kevin O'Higgins.

It will also examine how Sgt McCabe's allegations were handled by garda management, the Garda Síochána Ombudsman Commission and the former minister for justice.

The commission is expected to report within a year. 

The Guerin Report, which was published in May, found that the allegations made by Sgt McCabe required further investigation.

Former minister for justice Alan Shatter had said the allegations had already been examined by gardaí, GSOC and the Director of Public Prosecutions, and while some gardaí had been disciplined, none were prosecuted.

Sgt McCabe has welcomed the terms of reference.

Wilson calls on gardaí to put truth before loyalty

Whistleblower and former garda John Wilson has welcomed the establishment of the commission.

Speaking on RTÉ's News at One, he called on gardaí to put truth before loyalty when the commission begins its work.

He said: "I am calling on all members of An Garda Síochána who will be interviewed by this Commission of Investigation to resist putting loyalty to their colleagues ahead of honesty and truth.

"I believe that the victims of alleged garda malpractice deserve nothing less.

"We want the facts to emerge. We don't want this investigation hurried."

The Garda Representative Association has also welcomed the commencement of the Commission of Investigation.

It said it hoped gardaí in Bailieboro would now get a chance to tell their side of the story.

Speaking on RTÉ's Morning Ireland, James Morrisroe of the Cavan Monaghan division of the GRA said his members would cooperate fully with the investigation and had nothing to fear from it.

He said: "The GRA has been calling for this for a number of months.

"It's seven-and-a-half months ago nearly since the Guerin Report was published and we've consistently called for a commission to be set to get the truth out there, the whole truth and nothing but the truth."

The Guerin Report stated that gardaí did not seem to have been able to heed the voice of a man held in high regard by his immediate superiors.

It recommended the establishment of a Commission of Investigation to inquire into a number of incidents.

These include the possible sexual assault of a woman on a bus, the false imprisonment of another woman, the assault on a female taxi driver and the abduction of a child by a convicted murderer.

Mr Shatter resigned after the Taoiseach handed him a copy of the report.

He has since applied to the High Court seeking to have some of the report's findings quashed.
