Water protest case adjourned until 5 November

An application to have nine water charge protesters jailed or fined for breaching a High Court order has been adjourned until 5 November.

The protesters deny claims by the company installing the water meters, GMC/Sierra, that they breached the order which prevented them from assaulting, harassing, interfering or obstructing anyone working on behalf of the company installing meters in the Dublin area.

The case was adjourned to allow the protesters to respond to the claims.     

One protester, John D'Arcy, gave an undertaking to comply with the order.  

Mr Justice Paul Gilligan refused to accept undertakings from the other eight that they would be of lawful behaviour.     

The court heard they did not want to give undertakings in the exact terms of the High Court order as they felt that would amount to an admission that they had breached it.

The company wanted the court to vary the original order to restrain protesters from coming within 20 meters of the works to install the water meters.  

However that matter has also been adjourned for a fortnight.  

Senior Counsel Jim O'Callaghan said protesters were gathering around the area where the works were to be carried out and that work was not then being carried out.

Mr Justice Gilligan reminded the protesters in court that they had a lawful right to protest but the workers had a lawful right to install the meters.

He told them they could protest, but they could not stop the workers installing the meters.  

He gave both sides permission to come back to court on 24 hours' notice.

After the case finished, the protesters in court cheered and clapped and a number of them then marched down the north quays towards O'Connell Bridge.
