DPP begins appeal over Lyons sentence

The Director of Public Prosecutions has begun an appeal against the leniency of the sentence handed down to aviation broker Anthony Lyons for sexual assault.

Mr Lyons was sentenced to six years in prison last year for sexually assaulting a young woman while she was walking home in October 2010.

But the Circuit Court judge suspended all but six months of that sentence.

Judge Desmond Hogan also ordered Mr Lyons to pay compensation of €75,000.

The sentence was strongly criticised by a number of groups, including the Rape Crisis Centre.

Mr Lyons was released from prison in December last year.

Senior Counsel Caroline Biggs told the Appeal Court that the trial judge had failed to have regard to the gravity of the offences.

She said he had given undue weight to and had disproportionately relied on mitigation, particularly the issue of compensation.

Ms Biggs said that serving six months of a custodial sentence in no way reflected the gravity of the offences or the impact on the victim and did not reflect the fact that there should be a deterrent principle in the sentencing process.
