Prosecution finishes evidence in Dwyer trial

The prosecution in the trial of Graham Dwyer for the murder of Elaine O'Hara has finished giving evidence.

Earlier, one of the gardaí who led the investigation into the death of Ms O'Hara told the Central Criminal Court that he had never come across a case like this in his career.

Detective Sergeant Peter Woods said the case had attracted huge media attention. 

He said it was the most unusual case he had ever come across in his life.

He was continuing his evidence about interviews conducted with Mr Dwyer after his arrest for the murder on 17 October 2013.

Lawyers for Mr Dwyer asked him about information which appeared in the media during Mr Dwyer's first interview.

He agreed some of this had come from gardaí.

Det Sgt Woods said he thought it was "disgraceful" that the information was out there. He said it did not help the investigation or anybody.

Mr Justice Tony Hunt said similar sentiments had been expressed by the Supreme Court in recent days.

He said the Chief Justice had said people with responsibility should do something about it and he said "we can all echo that comment."

Det Sgt Woods said he definitely did not accept a suggestion from Mr Dwyer's senior Counsel, Remy Farrell that there had been a concerted effort by gardaí to ensure a media frenzy around Mr Dwyer's arrest.

Earlier, the jury was shown an entry in Ms O'Hara's address book which gives an 083 mobile phone number for a man called "Graham".

The mobile phone number is one of two numbers the prosecution says are linked to Mr Dwyer and which he used to contact Ms O'Hara.

It was put to Mr Dwyer during his interviews after he was arrested.Mr Dwyer said it was not his phone.

Under cross examination Det Sgt Woods said a lot of what was elicited in Mr Dwyer's first interview was elicited in general conversation.

He said there was no attempt to engage in subterfuge in the interviews.

Det Sgt Woods agreed that Mr Dwyer's solicitor had asked for information from gardaí about what the case was about.

He agreed that he would not give him information as he did not want information coming back from Mr Dwyer second hand.

He said he did not want any information coming back to him contaminated.

Sgt Woods was asked by lawyers for Mr Dwyer about video clips discovered on hard drives at Mr Dwyer's home.  

Some of the clips have been seen by the jury.

He agreed the women in the clips were from different walks of life. 

Some were professional women, some were not. Some of the women were filmed on more than one occasion.

The court also heard about Mr Dwyer's final interview with gardaí in the early hours of the morning of 18 October 2013.  

Detective Sergeant John Colgan put material to Mr Dwyer that had been downloaded from his work phone, a HTC phone with an 087 number, that had been taken from him the previous morning.

The material included a close-up of a stab wound as well as images of women who had been stabbed.   

Mr Dwyer said they were likely to be extracts from horror movies.

Sgt Colgan asked him why he needed to look at this material.

Mr Dwyer said he could not explain it. He knew it was sick.

At the end of the interview, he said he was not guilty of the offence he had been presented with.     

He also said from what he had heard and what he knew from before there were lots of people the gardaí should talk to as well as him and that had not been done in his opinion. 

He said these were other people "like him" who had been in contact with Ms O'Hara.   

He also asked gardaí not to present that he only looked at that kind of material - he also looked at other things on his phone.

The final witness in the prosecution case was Garda Darren Kerins.  He was witness 194 on day 37 of the trial.

He gave evidence about driving a number of routes in October 2013.

He told the court he drove from 23 lower Baggot Street - the offices of architects' firm A&D Wejchert - to a road near Shanganagh Park in Shankill, starting at just after 5.10pm in the evening. He said this took him 38 minutes.

He also drove from Kilakee Woods to Mr Dwyer's home in Kerrymount Close in Foxrock via the Reservoir in Roundwood, starting at 7.30pm.

He said this took him 55 minutes.

A journey from Carrickmines Retail Park to Kilakee Woods took 19 minutes.

When Garda Kerins finished his evidence shortly before 1pm, Senior Prosecuting Counsel, Sean Guerin told the court that was the end of the prosecution evidence.

Mr Justice Tony Hunt told the jury they had now heard the case "in flesh and blood". Everyone now had to stand back and look at it.

He told the jury there would be some legal discussions on Monday and he asked them to return on Wednesday morning.

He told them to put the case aside until then and that the only opinions in this case that were important were their own.
