Cork trial to hear man 'met gruesome death'

The jury in the trial of a homeless man, whose body was found in a waste chute, has been told that they will hear he "met a gruesome" death.

Prosecuting Counsel Sean Gillane SC was addressing the jury of seven women and five men on the opening day of the trial of David O'Loughlin.

Mr O'Loughlin, 28, has pleaded not guilty to the murder of Liam Manley, 59, at the Garden City Apartments on North Main Street in Cork City on 12 May 2013.

Mr Gillane told the Central Criminal Court, sitting in Cork, that they would hear evidence that while the two men did not know each other, early in the hours of 12 May they entered the accused's apartment block and went to his apartment at No 10, on the top floor.

The jury will hear from a number of witnesses including an acquaintance of the accused, David O'Mahony.

His evidence will allege that when he entered the apartment, Mr O'Loughlin starting verbally and then physically assaulting Mr Manley - an older and quiet man, who looked frightened.

He will say that he asked Mr O'Loughlin to stop, but was told to shut up and sit down.

He will claim that it ended with the deceased being dragged out of the apartment by Mr O'Loughlin.

He will claim that he heard the shutting of a steel door, but that he did not believe the accused when he said the deceased "was down the drain".

Mr Gillane said the jury will also hear from Michael Forde, a maintenance man who received a complaint that the rubbish chute at the apartment building was blocked on 12 May.

In his evidence, he will say that clearing the chute proved difficult, and he was about to give up, but ultimately using rods managed to unblock it.

He will describe initially thinking copious amounts of red liquid was sauce, before realising it was blood and finding Mr Manley's remains.

Mr Gillane said the jury will also hear evidence that despite being found on 12 May, Mr Manley's body was in a state of advanced decomposition because of the environment of the chute, being blocked with rubbish below and above him.

They will hear that his death was caused by mechanical asphyxia after being trapped in the waste chute.

There will be evidence of attempts by Mr Manley to stop himself being placed in the chute.

Mr O'Loughlin, of Garden City Apartments, denies murdering Mr Manley.

The case, which is being presided over by Mr Justice Paul Carney, could last for up to three weeks.
