Labour 'ludicrous' to impose whip on vote - Daly

Independent socialist TD Clare Daly has said it is "ludicrous" for the Labour leader Joan Burton, to impose the party whip on TDs ahead of a vote in the Dáil on a bill allowing for terminations in cases involving fatal foetal abnormalities.

Earlier, Labour TD Anne Ferris said she will be voting against the Government and supporting the bill.

Ms Daly said if the TDs "had any conscience" they would vote in favour of the bill, which she has sponsored, especially given that 20 Labour TDs wrote a letter to the then minister of health, a number of years ago, calling for such legislation. 

She said it would be "a shameful day" if the Bill did not go through.

Speaking on RTÉ's Morning Ireland, she said the whip was being imposed on the grounds that the Bill was unconstitutional. 

She said only the courts could adjudicate on whether a Bill was constitutional or not, and she called on the Government to publish the advice given by the Attorney General in this regard.

Ahead of the vote this evening, Labour deputies will get a briefing on the legal advice that the Government has received which indicates the bill is unconstitutional and a referendum is required to address the issue.

Particular attention will on the Labour TDs, some of whom have advocated in the past for legislation to allow terminations in cases involving fatal foetal abnormalities.

Wicklow TD Ms Ferris said she would be voting for the bill.

Speaking on the Claire Byrne Live programme on RTÉ television, she said the issue was above politics and added she would accept the consequences.

A Labour spokesman said voting against the party automatically results in loss of the whip. 

A number of other Labour TDs have also questioned the legal advice. 

Minister for Pubic Expenditure and Reform Brendan Howlin said Labour want to give real redress to people dealing with fatal foetal abnormality and not enact legislation that is constitutionally infirm, which he said would be cruel.

He was speaking on his way into this morning's Cabinet meeting.
