Judge halts Obama's immigration plans temporarily

A US federal judge in Texas has temporarily halted President Barack Obama's immigration reforms that could have benefited up to five million illegal immigrants.

Judge Andrew S Hanen of the Federal District Court in Brownsville, Texas filed an order late yesterday that bars the Obama administration from carrying out his reform programme - the first part of which was due to become operational tomorrow.

Texas and 25 other States had filed a lawsuit against the Obama initiatives, claiming the schemes caused "dramatic and irreparable injuries" to them.

Judge Hanen ruled that President Obama had overstepped his authority and that the administration had failed to comply with the basic procedures for putting such sweeping reforms into place.

In more than 120 pages of court documents lodged late yesterday, Judge Hanen granted an injunction against the reform programmes and allowed the 26 States' lawsuit to go ahead.

In a statement, the White House said the decision from the Texas District Court "wrongly prevents" the President's "lawful, common sense policies" from taking effect and that the Department of Justice would be appealing the decision.

The statement from the White House Press Secretary Josh Earnest, pointed out that the "Department of Justice, legal scholars, immigration experts and the district court in Washington DC" had all determined that President Obama did have the legal authority for his executive actions.

The first scheme - an extended Deferred Action for Childhood Arrivals scheme - was due to begin accepting applications tomorrow.

That is a programme that would protect people against deportation provided they had arrived in the US before their 16th birthday; that they had lived continuously in the US since 1 January 2010 and that they have been "without legal status" since at least June 2012.

Provided they were a past or present high school student or honourably discharged veteran and could pass a criminal background check, they would be allowed to remain in the US and apply for work permits.

The second main part of President Obama's reforms offers protection against deportation for three years to the parents of US citizens or permanent residents provided they have lived in the US illegally for at least five years, passed a background check and paid taxes and social security.

President Obama's executive actions had been expected to benefit up to five million undocumented immigrants in the US. 

There are about 12 million illegal immigrants in total in the US.

There are believed to be about 50,000 illegal Irish immigrants in the US, many of whom could benefit from the reforms contained in President Obama's programmes.
