Witness tells Bailey case of 'mental breakdown'

A man who says gardaí gave him cash and cannabis to get information linking Ian Bailey to the murder of Sophie Toscan du Plantier has said he spent 18 years hiding from what had happened between him and the gardaí.

Martin Graham is being crossed-examined by lawyers for the gardaí and the State in the action by Mr Bailey for wrongful arrest.

Mr Graham came under sustained questioning about his life in the army and his medical history before he moved to Ireland by Senior Counsel for the State Paul O'Higgins.

Despite repeated objections from counsel for Mr Bailey as to the relevance of the questions, Mr O'Higgins said it was relevant to his credibility as a witness.

Mr Graham said he was unable to remember where he was based after leaving Northern Ireland in 1982 having served two years, some of it as an undercover soldier.

He said he had a mental breakdown and there was a blank space in his head about that period and his doctors could confirm that.

He was asked how could he tell the jury what happened in a three-month period in Cork in 1997 when he could not remember many years of his earlier life.

Mr Graham said it was because had spent 18 years hiding from it.

He was asked if he had any objection to the State accessing his army and medical records and said:

"Yes I have an objection to the gardaí talking to the British forces. The same gardaí that I trusted?"

He said it was his private life and he failed to see the relevance of that information to his case.

He said his mind was "buggered in the sense of what the army did to me. It took me a long time to recover".

He said he could not remember where he lived or was posted for eight years after he left Northern Ireland, nor could he remember the exact year he got married.

Yesterday, Mr Graham said gardaí had threatened him with the "Provos" because they knew he had served with the British army in Northern Ireland.

Mr Bailey, 57, from the Prairie, Schull in west Cork, is suing the Garda Commissioner, Minister for Justice and the Attorney General for damages in relation to his treatment as a suspect for the murder of Ms Toscan Du Plantier in west Cork in December 1996.

The defendants deny the claims.
