Lawyers for the family of the former billionaire businessman Seán Quinn have asked the Dublin Circuit Criminal Court for transcripts of the trial of three former directors of Anglo Irish Bank.
52-year-old Pat Whelan and 63-year-old William McAteer were convicted last April of illegally lending money to ten investors to buy shares in the bank.
They were acquitted of illegally lending money to six members of the Quinn family.
The bank's former chairman Seán FitzPatrick was acquitted of all 16 charges.
Lawyers for the Quinns told the court they wanted the transcripts for their civil actions against the former Anglo Irish Bank and against the Central Bank and others.
The Quinns claim they are not liable to repay almost €3bn in loans from Anglo because they say the money was given for the illegal purpose of propping up the bank's share price.
Barrister, Charlotte Simpson, said many witnesses who gave evidence in the criminal proceedings were also witnesses in the civil proceedings in the commercial court. She said there would be a massive overlap in the type of evidence called.
Ms Simpson said that furnishing the Quinns with the transcript was in the interests of justice because it would allow all sides in the civil actions to "agree substantial amounts of evidence" and thus save time and costs.
The application was opposed by lawyers for Mr Whelan and Mr Fitzpatrick. Lawyers for Mr Whelan described the request as a fishing expedition.
The first civil action by the Quinns is due to begin in April next year.
Judge Martin Nolan asked how any party could be prejudiced by having a true record of what was previously said in trial. He adjourned the matter to 28 October for a full hearing.
