Fossett's Circus facing potential collapse

Fossett's Circus is insolvent and facing potential collapse, the Circuit Civil Court has been told.

The famous family business, based in Lucan, Co Dublin, is to consider asking the court to appoint an examiner in a fortnight's time.

Barrister Ross Gorman said an independent accountant's report indicated the business would have a reasonable prospect of survival under examinership.

The company, which traces its origins back to the 1880s, employs 16 people.

Mr Gorman told the court that while Fossett Brothers was not seeking the immediate appointment of an interim examiner, this might be the only outcome when the application returned before the court in a fortnight.

He said current company directors Robert Fossett Jnr and Edward Fossett Jnr would advertise their application for the appointment of an examiner and put on notice the Revenue, the county council and the executor of wills of three deceased founding directors.

However, it is still business as usual for the circus, which is running performances in Swords in Dublin over the next week.

The circus can trace its roots back to a troupe started by Corkman George Lowe who toured Ireland before emigrating to the US, where he joined the troupe headed by William Cody, aka Buffalo Bill.

Lowe, who specialised in magic, juggling and trick-riding horses, returned to Ireland in 1887 and embarked on tours of the country with his own circus troupe.

Accomplished horseman Edward Fossett joined Lowe's circus in 1918 and later married his daughter, Mona Lowe.

The couple had six children all of whom followed their parents into the business, eventually setting up the Edward Fossett and Sons Circus, which has been handed down through the family.

The court heard that a family dispute led to High Court proceedings, which started in 1992 and did not end until 2008, with a settlement bill of €500,000 that still hangs over the company.

Mr Gorman told Judge Linnane that accountant Joseph Walsh had agreed to act as examiner should the court consider such an appointment necessary.
