Thursday 03 July 2014 16.14 Former Fianna Fáil Cork City councillor Gary O'Flynn has been jailed for one year on deception charges.
O'Flynn, 39, of Castle Court, Whitechurch, Co Cork, a solicitor and financial adviser, was found guilty by a jury last month of 13 counts of deception.
Sentencing had been adjourned until today.
He received a three-year sentence with the final two years suspended.
O'Flynn had appealed for leniency having cited his depression and anxiety and the fact that he had been on suicide watch in prison.
His father, former TD Noel O'Flynn, apologised to the victim, Eric Higgins, on behalf of the O'Flynn family.
He said over €6,000 was paid to him in respect of money stolen from him.
Mr O'Flynn said his son's personality changed in 2009 and he descended into a serious depressive disorder.
During his five-day trial last month, Gary O'Flynn claimed all payments made to him were for fees due to him for his work as a solicitor.
However, Mr Higgins said his understanding was that he was making weekly payments to an account nominated by Gary O'Flynn to pay his creditors and was shocked to find out from his creditors much later that the monies were not being sent on.
One of the investigating gardaí, Detective Michael Horgan told Cork Circuit Criminal Court that complaints were made to GSOC about him and every other member of the force who had dealings with O'Flynn's family and he believed this was done in an effort to frustrate the investigation.
Judge Seán Ó Donnabháin described elements of O'Flynn's evidence as bizarre as they had not been presented to his own defence team.
But he said that since his imprisonment five weeks ago there had been a change in him.
Judge Ó Donnabháin said he had since admitted to the wrongdoing and repaid the monies.
He said there had to be a custodial sentence and save for his depressive disorder, it would be longer.
