Garda fails to preserve anonymity in court bid

A garda accused of possession of over 650 images of child sexual abuse has failed to preserve his anonymity.

The garda, who is in 50s, is stationed at a Dublin garda station.

He is currently on suspension.

He told the judge in Blanchardstown District Court today that he would be pleading not guilty to the charge, which relates to images and movie files of explicit child sex, child exposure, and other graphic images.

The garda also applied for reporting restrictions imposed at the last hearing to be renewed.

He said that publication of his name would put him at risk of attack, which could affect his right to a fair trial.

Legal representatives for RTÉ, the Irish Mail and Independent Newspapers opposed the application on the grounds that the law was very clear, the defendant had no right to anonymity and the court had no discretion in the matter.

The Director of Public Prosecutions submitted that the garda's claim that his life could be at risk was hypothetical.

Judge David McHugh said he was satisfied that identifying the garda posed no real risk of an unfair trial and lifted reporting restrictions.

However, he put a stay on the order until 5pm to allow the garda to decide whether or not he would apply for a judicial review of the ruling.
