Inquiry chair seeks Praveen Halappanavar meeting

The Health Service Executive has said the chairman of the team inquiring into the death of Savita Halapannavar has sought a face-to-face meeting with her husband, Praveen Halappanavar.

The HSE also said that the executive is taking very seriously the concerns of the family about the composition of the team, which is being headed by Prof Sabaratnam Arulkumaran.

The development comes after the solicitor for the Halappanavar family said Mr Halappanavar has no faith in the HSE inquiry into her death and will not cooperate with it.

Ms Halappanavar died following a miscarriage at Galway University Hospital on 28 October.

Speaking on RTÉ's Today with Pat Kenny, Gerard O'Donnell said Mr Halappanavar will not consent to have Savita's records looked at by the HSE inquiry team.

Mr O'Donnell said Mr Halappanavar would be essential to any inquiry as he was a very important witness.

He said Mr Halappanavar wants an independent inquiry.

This would see oral hearings held in public, a full discovery of records and witnesses called in under oath and cross examined in public.

Mr O'Donnell said: "Any inquiry conducted by the HSE does not meet with his approval. He has no faith in the HSE.

"It's important to remember that he lost his wife while under the care of the HSE," he added.

"He (Praveen) feels that anybody who is appointed by the HSE or paid for by the HSE to conduct an inquiry into his wife's death won't meet the criteria that we would advise him as lawyers of getting to the truth," Mr O'Donnell said.

Mr O'Donnell said the removal of the three consultants from the Galway hospital from the inquiry team would not be enough to meet Mr Halappanavar's concerns.

Mr Halappanavar returned to Galway from India on Sunday.

Through his solicitor, he plans to request that there be no-one from Galway on the inquiry team.

Mr Halappanavar's solicitor has already written to Minister for Health James Reilly seeking a full public inquiry into the death.

He also said he does not believe there would have been any inquiry other than an inquest, if there had not been public pressure.

He said the scale of the media attention has been a shock for his wife's family, who were overwhelmed by the numbers involved in Saturday's vigil in Dublin.

Martin calls for new panel

Fianna Fáil leader Micheál Martin has called on the Minister for Health to reconfigure the panel inquiring into the death of Ms Halappanavar.

On RTÉ's News at One Mr Martin said he was "genuinely taken aback" by the inclusion of three people from the same hospital in which Ms Halappanavar died on the panel.

He also called for an entirely independent panel outside of the HSE that would command the confidence required.

Earlier today, the Irish Council for Civil Liberties called for the inquiry to be fully independent.

The council's director, Mark Kelly, said that Mr Halappanavar had raised an arguable claim in relation to his late wife's treatment, and this placed an procedural obligation on the State to conduct an effective official investigation.

Going into a Cabinet meeting this morning, Minister for Education Ruairi Quinn said the people directly involved should be allowed conduct their inquiry and they are best placed to decide if another investigation is needed.

Last night, Minister for Social Protection Joan Burton said the holding of the HSE inquiry would not prejudice subsequent inquiries.

Senators unhappy with inquiry team

Two Government party Senators have called for the composition of the HSE inquiry team to be reconsidered.

The Labour leader in the Seanad, Senator Ivana Bacik, said in the Upper House that she was unhappy with the current make up of the inquiry team, and that she agrees with Ms Halappanavar's husband on the matter.

Senator Bacik said that having three doctors from UCHG would not satisfy the legal precept of rule against bias. She said the input of the hospital experts could be much more robustly had as witnesses.

Fine Gael Senator Fidelma Healy-Eames also asked the Leader of the Upper House to intervene to look again at the format of the inquiry team into events at UCHG given Mr Halappanavar's unhappiness over the matter.

She said that one member of the inquiry team from UCHG would have been more than adequate.

Ms Healy-Eames it was vital to have the results of the Savita case as soon as possible.
